Lindsay Clemons & Associates provides real estate closings in Lowndes County, Mississippi, and beyond. Our team leverages our legal expertise and community knowledge to ensure our clients and their partners feel right at home by handling both the closing process and all things title for our transactions.

We prepare deed transfers in accordance with state law and regulations and conduct title searches as well as obtain title insurance policies for our customers. We work hard to keep things moving forward and have the flexibility to adapt when our problem-solving skills are needed. It’s this commitment and transparency that has already made us one of the most respected real estate law firms in the Golden Triangle after our first few years.

Though Lindsay herself is a former prosecutor – and still serves the youngest in our community as an attorney advocate for the Lowndes County Youth Court, our firm only handles residential and commercial closings and other real estate-related matters. Our team would love the opportunity to assist you in your relocation to our welcoming area. Home closings can get complicated for those unable to visit our office in person due to state laws and regulations. (For example, there is no Remote Online Notarization (RON) here, and we’ll need wet-ink signatures on any documents filed with the county clerk’s office.

However, we do everything – including making sure you have the right POAs to satisfy the state’s and your lender’s requirements – so we can make your experience as smooth as possible, no matter your circumstances.

You just put an offer in on a new home – and it was accepted. The journey is over for both you and the seller, right? Not exactly. In fact, some would say now is when the fun begins. There are still multiple steps to climb – and hurdles to jump through before a new chapter can start.

In fact, this is the point of the adventure where the Lindsay Clemons & Associates team comes in. Since Mississippi is a real estate attorney state – meaning a lawyer must oversee the preparation of the deed of any property bought and sold in the Magnolia State – you must choose an attorney to help you close. Our team would love to be that choice. How do we prepare for your closing? By doing plenty of research, examination and double-checking. First, we’ll conduct a title search – a deep dive into property records and documents to confirm the seller really can sell the property to you.

What else are we looking for during this important search? Any undiscovered liens, unknown heirs, evidence of fraud or anything else that may hinder the sale. Then, we’ll work with our underwriter, the Commonwealth Land Title Insurance Company, to obtain the correct title insurance policies for the property.

What is title insurance? Consider it your – and your lender’s – protection from any claims of ownership that haven’t arisen yet. If issues do arise during this process, you can rest assured we’ll use our legal expertise and real estate knowledge to untangle them.

While we’re doing this important work, you’re likely also getting a home inspection done, depositing money into escrow and working with your loan officer to ensure everything else is in order for your big Closing Day celebration.

Here's what to expect on Closing Day

It’s the day you’ve been waiting for! After weeks of waiting since you put in your offer, you’re finally ready to get to the closing table and get the keys to your dream home. Coming to closing prepared is essential, so we prepared this guide of what to expect at a Lindsay Clemons & Associates closing.

Documents to Sign

When it comes to closing on a home, sellers may have to sign up to 100 documents (yes, really!). But as a buyer, here are the six key documents you’ll typically sign:
If this sounds like a lot, don’t worry! You’ll have a knowledgeable team by your side every step of the way—making sure your closing day is smooth and seamless.

  • Closing Disclosure: This document details your mortgage and closing costs, including your one-time fee for title insurance. You are required by law to receive this at least three days before closing, and we’ll be the ones providing it.
  • Loan Estimate: This estimate provides similar information to your closing disclosure, so it’s crucial that they match. It’s also critical to confirm that the information on your loan estimate is similar to the estimate you received at the beginning of the closing process.
  • Promissory Note: This is an agreement to pay the lender back for the money they are lending you in the mortgage.
  • Escrow Account Documents: These set up the account your title agent manages to pay for items such as property taxes and homeowners insurance.
  • Deed of Trust: This is a legal document that secures a loan for a real estate purchase.
  • Warranty Deed: This transfers the property for the previous owner to you.

What to Bring to Closing

  • Two forms of ID
  • Cashier’s Check, Bank Check or Wire Info*
    • *BEWARE* Fraudsters are always looking for an opportunity to infiltrate the closing process and steal your hard-earned money through wire fraud. If you get any suspicious messages about changing the wire instructions soon before or after closing, call your title agent directly to confirm.

Get Your Keys

Now it’s time to celebrate! Once all the documents are signed, you can head to your new home. While you’re bringing in the furniture, our team will review all your documents and record them with the proper local government office so you can enjoy your new home with added peace of mind that everything was handled with care by your real estate attorney!
